Terms of Service/Acceptable Use

1. SERVICE DESCRIPTION

JLK Hosting currently provides users with access to a selection of resources, including free web hosting, use of our nameservers, free server space, free data transfer, free email and personalized content, through its network (the "System"). Unless explicitly stated otherwise, any new features that enhance the current System, including the release of new JLK Hosting features, shall be subject to the TOS. You understand and agree that the System is provided "AS-IS," and that JLK Hosting assumes no responsibility for the timeliness, deletion, miss-delivery or failure to store any user communications or personalization settings.

2. REGISTRATION OBLIGATIONS

In consideration of Your use of the System, You agree: (a) that You are at least 18 years of age; (b) to provide true, accurate, current and complete information about Yourself as prompted by the registration form (this information will comprise the "Database"); and (c) to maintain and promptly update the Database to keep it true, accurate, current and complete. Non-compliance with any of these obligations during the maintenance of Your account may result in the suspension or termination of Your account, and may result in the refusal of any and all current or future use of the System, or any portion thereof at the sole discretion of Us.

3. MEMBER ACCOUNT INFORMATION

You will receive a password and account designation upon completing the System's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under Your password or account. You agree to (a) immediately notify Us of any unauthorized use of Your password or account or any other breach of security. We will not be liable for any loss or damage arising from Your failure to comply with this Section.

4. MEMBER CONDUCT

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the entity from which such Content originated. This means that You, and not JLK Hosting, are solely responsible for all Content that You upload, post, email or otherwise transmit via the System. We do not control the Content posted via the System and as such, do not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will We be liable in any way for any Content, including but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the System. You agree to not use the System to: (a.) Upload, post, email or otherwise transmit any Content that is directed to inciting or producing imminent conduct that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable and is likely to produce such conduct; (b.) Harm minors in any way; (c.) Impersonate any person or entity, including, but not limited to, a JLK Hosting official or falsely state or otherwise misrepresent Your affiliation with a person or entity; (d.) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the System; (e.) Upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);( f.) Upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; (g.) Upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or "pyramid schemes;" (h.) Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (i.) Interfere with or disrupt the System or servers or networks connected to the System, or disobey any requirements, procedures, policies or regulations of networks connected to the System; (k.) Intentionally or unintentionally violate any applicable local, national or international law; (l.) Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.

5. INTELLECTUAL PROPERTY INFRINGEMENT

As a condition for your use of our services offered and defined by our System, you represent and warrant that your registered domain name does not violate the intellectual property rights of any third party. In the event you are found to have breached your obligation pursuant to this section and your domain name is using any of our services offered and defined by our System, you agree that all your information could be deleted from the System. Before deleting your data, we will give you the chance to prove us that you are the legitimate holder of the content you are having associated with your account. You further agree that we may demand at any time proof of any intellectual property ownership or licensing, as the case may be, to ensure your compliance with this section.

6. SPECIAL CONSIDERATIONS FOR INTERNATIONAL USE

You agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, You agree to comply with all applicable laws regarding the transmission of technical data exported from the the country in which You reside.

7. CONTENT SUBMITTED TO JLKHOSTING.COM

You agree that JLK Hosting and its designees have the right to refuse any Content that is available through the System. Additionally, JLK Hosting and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that You must evaluate and bear all risks associated with the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. You acknowledge and agree that We may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS and (c) respond to claims that any Content violates the rights of third-parties. You understand that the technical processing and transmission of the System, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

8. INDEMNITY

You agree to indemnify and hold JLK Hosting, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of Content You submit, post to or transmit through the System, Your use of the System, Your connection to the System, Your violation of the TOS, or Your violation of any rights of another.

9. PROHIBITION AGAINST RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the System, use of the System, or access to the System, unless you have purchased a "RESELLER HOSTING" account or a "VIRTUAL PRIVATE SERVER" account.

10. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that JLK Hosting.com may establish general practices and limits concerning use of the System, including without limitation the maximum number of days that email messages or other uploaded Content will be retained by the System, the maximum number of email messages that may be sent from or received by an account on the System, the maximum size of any email message that may be sent from or received by an account on the System, the maximum disk space that will be allotted on JLK Hosting's servers on Your behalf, and the maximum number of times (and the maximum duration for which) You may access the System in a given period of time. You agree that JLK Hosting has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the System. You acknowledge that JLK Hosting reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that JLK Hosting reserves the right to change these general practices and limits at any time with or without prior notice. You agree that all content uploaded to JLK Hosting's servers will be related to your site hosted with JLK Hosting. You agree not to use JLK Hosting's server as a storage facility or backup repository for another site at another location. Doing so will be grounds for suspension or termination of your account at JLK Hosting without prior notice and immediate deletion of all content. JLK Hosting's servers are not to be used for file storage or distribution. At least 80% of the storage space that you use must be for files directly accessible from your website.

11. MODIFICATIONS TO SYSTEM

JLK Hosting reserves the right at any time to modify or discontinue, temporarily or permanently, the free hosting System, or any part thereof with or without prior notice. You agree that JLK Hosting shall not be liable to You or to any third party for any modification, suspension or discontinuance of the System.

12. TERMINATION

You agree that JLK Hosting may terminate Your free hosting password, account, jlkhosting.com Site, use of the System, or use of any other JLK Hosting.com service, and remove and discard any Content within the System, for any reason, including, without limitation, for lack of use or if JLK Hosting believes that You have violated or acted inconsistently with the provisions of the TOS. JLK Hosting may also, at any time, discontinue providing the System, or any part thereof, with or without prior notice. You agree that any termination of Your access to the System under any provision of this TOS may be effected without prior notice, and acknowledge and agree that JLK Hosting may immediately deactivate or delete Your account and JLK Hosting Site and all related information and files in Your account and JLK Hosting Site and/or bar any further access to such files or the System. Further, You agree that JLK Hosting shall not be liable to You or any third-party for any termination of Your access to the System.

13. OTHER GROUNDS FOR TERMINATION

We reserve the right, in our sole discretion, to terminate your free hosting service with respect to any domain name that you subsequently transfer to another registrar. You understand and acknowledge that your continued use of our free hosting service is conditioned on your domain remaining registered with us and not violating our other stated conditions.

14. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: A. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JLK Hosting EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. B. JLK HOSTING MAKES NO WARRANTY THAT (i) THE SYSTEM WILL MEET YOUR REQUIREMENTS, (ii) THE SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OTHER THAN WHAT IS STATED IN OUR SLA, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SYSTEM WILL BE ACCURATE OR RELIABLE.

15. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT JLK HOSTING SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JLK HOSTING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SYSTEM; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SYSTEM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SYSTEM; OR (v) ANY OTHER MATTER RELATING TO THE SYSTEM.

16. NOTICE

Notices to You may be made via either email or regular mail. The System may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to You generally on the System.

17. MODIFICATION

We may modify any of the terms and conditions contained in this TOS at any time and in Our sole discretion. A change notice will be posted on Our Site and shall be effective after three (3) days after they are posted on Our Site.

18. GENERAL INFORMATION

This TOS constitutes the entire agreement between You and JLK Hosting and governs Your use of the System, superseding any prior agreements between You and JLK Hosting. The TOS and the relationship between You and JLK Hosting shall be governed by the laws of the Commonwealth of Virginia, USA without regard to its conflict of law provisions. You and JLK Hosting agree to submit to the personal and exclusive jurisdiction of the courts located in the Commonwealth of Virginia, USA. The failure of JLK Hosting to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties agree that the court should proceed to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the System or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

19. VIOLATIONS

Any violations of the TOS should be reported to Us immediately via support ticket or by email, using abuse [at] jlkhosting.com. In the event that You breach any of the above provisions of this Agreement, You agree that We may terminate Your use of Our System. In the event such a breach occurs by You, We will post a page from Your domain name stating that You have violated Our terms and conditions of service.

JLK Hosting Web Hosting Customer Restrictions

Server Resources

Any Web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to reduce the resources used to an acceptable level, or upgrade its service to a Dedicated Server plan. JLK Hosting will be the sole arbiter of what is considered to be a high server usage level. JLK Hosting will take a decision based upon the average usage of resources and the peak usage of the resources. A usage that is consumes less than five percent of the CPU is considered to be normal and acceptable. Any Web Hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice. RSS aggregators are not allowed in private hosting plans and will be terminated if found.

Spamming

Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to JLK Hosting customers. The term "spamming" also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a Web site hosted on a JLK Hosting server, and selling or distributing software (on a Web site residing on a JLK Hosting server) that facilitates spamming. Violators will face immediate suspension. JLK Hosting reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision.

IRC

JLK Hosting does not allow IRC or IRC bots to be operated by Web Hosting customers.

Anonymous Proxies

JLK Hosting does not allow anonymous proxies (cgi, php, etc.) to be operated by Free Web Hosting customers. Paid Web Hosting customers may operate proxies so long as they do not consume disproportionate amounts of Server Resources as defined above.

Software Distribution

JLK Hosting Web Hosting accounts are not configured for the purposes of distributing software and/or multimedia products, or for file hosting or transfer sites, whether paid or free. This includes scripts such as "Rapid Leech" which is specifically not allowed on our servers. As stated, files housed on our servers must be related to and used for website content. Please contact us if you wish to distribute software and/or multimedia products.

Other Prohibited Content

JLK Hosting does not host sites dealing in foreign exchange (forex), pyramid schemes, stock trading or advice, gambling, get rich quick schemes, nulled scripts, warez, sites that compete with our services (with the exception of reseller and VPS accounts who may offer paid hosting), or any other material deemed potentially misleading or designed to defraud the public. Doing so will be grounds for immediate termination of your hosting account and deletion of all content.

Ownership of Web Site

The legal owner of customers' Web sites and accounts with JLK Hosting will be the individual or organization whose name is listed in JLK Hosting database as the owner. Customers will fully cooperate with and abide by any and all of JLK Hosting security measures and procedures in the event of any dispute over ownership of customers' Web sites and accounts with JLK Hosting.

Illegal Use

JLK Hosting servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation, or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Additionally, in purchasing JLK Hosting services, all JLK Hosting customers certify that they and/or the organization they represent in procuring services from JLK Hosting are not, nor have been designated, a suspected terrorist, are not owned or controlled by a 'suspected terrorist' and are not on, are not a member of, related to, associated with, or controlled by any organizations that the UN or the NATO considers to be associated with terrorism.

Copyright Violations

The US Digital Millennium Copyright Act ("DMCA") sets forth the law regarding the use of copyrighted materials on the Internet. All JLK Hosting customers are subject to the requirements of the DMCA. Individuals or entities submitting notifications of copyright infringement by an JLK Hosting customer (per the DMCA) to JLK Hosting must follow the below procedures. Customers who are the subject of a DMCA notification that meets the below criteria may be subject to account termination at JLK Hosting's sole discretion.

DMCA Copyright Infringement Notification Requirements:

• Physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf (the "Claimant").
• Identification of the copyrighted work(s) claimed to have been infringed.
• Identification of the material claimed to infringe the copyright(s), and enough information for JLK Hosting to locate it including URLs and specific descriptions of the infringing material at each URL.
• The Claimant's name, address, and telephone number(s).
• A statement that the Claimant has a good faith belief that use of the disputed material is not authorized by the copyright owner or his agent.
• A statement, under penalty of perjury, that the information in the notification of copyright infringement is accurate and that the Claimant is authorized to act on behalf of the copyright owner.
• Send the notification via mail to: support@jlkhosting.com

The DMCA contains very specific guidelines as to what proper notification of claimed infringement must contain. Copyright owners may obtain a copy of the DMCA, including these guidelines, by visiting the web site of the U.S. Copyright Office at http://www.copyright.gov/title17/92chap5.html#512. JLK Hosting is not required to respond to notices that do not meet the requirements of the DMCA. Copyright owners should be aware that there are substantial penalties for false claims and that JLK Hosting will actively refer complainants who use the DMCA for improper purposes to relevant law enforcement agencies. In the event that JLK Hosting must remove, or disable access to, material on your web site that is alleged to infringe another's copyright under the DMCA, you acknowledge and agree that JLK Hosting may do so by disabling access to your entire web site.

Child Pornography

The use of JLK Hosting services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. JLK Hosting is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services.

Additional Free Service Restrictions

Users of our free service are prohibited from using our service as a portal to another site, a forward to another site, a content "mirror", a frame within their main site, a subdomain of another private top level domain (a free subdomain is allowed), or for any site where the main content is password protected. Chat servers are not allowed. Chat clients will bhe considered on a case by case basis. Violation will be grounds for suspension or termination of your account at JLK Hosting without prior notice and immediate deletion of all content.

Indemnification

JLK Hosting customers agree to protect, defend, hold harmless, and indemnify JLK Hosting, any third party entity related to JLK Hosting (including, without limitation, third party vendors), and JLK Hosting executives, directors, officers, attorneys, managers, employees, consultants, contractors, agents, parent companies, subsidiaries, and affiliates, from and against any and all liabilities, losses, costs, judgments, damages, claims, or causes of actions, including, without limitation, any and all legal fees and expenses, arising out of or resulting in any from the customer's use of JLK Hosting services.

Disclaimer

The JLK Hosting service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. JLK Hosting expressly disclaims any representation or warranty that the JLK Hosting service will be error-free, secure or uninterrupted. No oral advice or written information given by JLK Hosting, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. JLK Hosting and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, AND UNDER NO THEORY OF LAW OR EQUITY, WILL ATGIG (INCLUDING, WITHOUT LIMITATION, ATGIG'S EXECUTIVES, DIRECTORS, OFFICERS, ATTORNEYS, MANAGERS, EMPLOYEES, CONSULTANTS, CONTRACTORS, AGENTS, PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, THIRD-PARTY PROVIDERS, MERCHANTS, LICENSORS, OR THE LIKE) OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING ATGIG'S SERVICES, BE LIABLE FOR THE LOSS OF A DOMAIN NAME, OR ANY BUSINESS OR PERSONAL LOSS, REVENUES DECREASE, EXPENSES INCREASE, COSTS OF SUBSTITUTE PRODUCTS AND/OR HOSTWAY SERVICES, OR ANY OTHER LOSS OR DAMAGE WHATSOEVER, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF ANY USE OF, OR ANY INABILITY TO USE, ANY ATGIG SERVICES EVEN IF HOSTWAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ATGIG'S TOTAL CUMULATIVE LIABILITY, IF ANY, TO CUSTOMER, OR ANY THIRD PARTY, FOR ANY AND ALL DAMAGES, RELATED TO THE TOS OR HOSTWAY'S SERVICES, INCLUDING, WITHOUT LIMITATION, THOSE FROM ANY NEGLIGENCE, ANY ACT OR OMISSION BY ATGIG OR ATGIG'S REPRESENTATIVES, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, WILL BE LIMITED TO, AND WILL NOT EXCEED, THE ACTUAL DOLLAR AMOUNT PAID BY THE CUSTOMER FOR THE SERVICES WHICH GAVE RISE TO SUCH DAMAGES, LOSSES AND CAUSES OF ACTIONS DURING THE 3-MONTH PERIOD PRIOR TO THE DATE THE DAMAGE OR LOSS OCCURRED OR THE CAUSE OF ACTION AROSE.

Modifications

JLK Hosting may discontinue, upgrade, replace, modify, or change in any way, without limitation, any software, application, program, data, hardware, equipment, or portions or components thereof, used to provide customers with JLK Hosting services. Certain changes to JLK Hosting services may affect the operation of customers' personalized applications and content. Each customer is solely responsible, and JLK Hosting is not liable, for any and all such personalized applications and content, except as expressly agreed to by JLK Hosting.

Backup of Data

Except where JLK Hosting has expressly agreed in writing to the contrary, customers are solely and entirely responsible, and JLK Hosting is in NO way responsible, for the management and backup of all customer data, and all updates, upgrades, and patches to any software that customers use in connection with JLK Hosting services. JLK Hosting servers are also not be used as a backup storage and is only intented for hosting web files. JLK Hosting will not be responsible for loss of back up data due to equipment failure or malicious acts or negligence of third parties.

Governing Law and Severability

The TOS, and any other agreement for JLK Hosting services, will be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA without reference to its conflicts of laws principles. Any litigation or arbitration between a customer and JLK Hosting will take place in Commonwealth of Virginia, USA, and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of the TOS or other JLK Hosting agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of the TOS or the agreement will continue in full force and effect.

Independent Contractors

Nothing in this Agreement will be construed as creating a partnership or relationship of employer and employee, principal and agent, partnership or joint venture between JLK Hosting and its customers. Each of JLK Hosting and its customers will be deemed an independent contractor at all times and will have no right or authority to assume or create any obligation on behalf of the other, except as may be expressly provided herein.

Construction and Interpretation

Wherever in this TOS the masculine, feminine, or neuter gender is used, it will be construed as including all genders, and wherever the singular is used, it will be deemed to include the plural and vice versa, where the context so requires. The division of the TOS into sections/paragraphs, and the insertion of headings/captions, are for convenience of reference only and will not affect the construction or interpretation of the TOS. Any rule of construction to the effect that any ambiguity is to be resolved against the drafting party will not be applicable in the construction or interpretation of the TOS.

Complete Agreement and Exclusivity

The TOS, and/or any other specific agreement for JLK Hosting services, constitutes the complete understanding and agreement between JLK Hosting and its customers. Except when expressly agreed to the contrary in signed writing by an authorized representative of JLK Hosting, the TOS supersedes any other written (including digitized/computerized) agreement, oral agreement, and/or agreement by conduct. This TOS, and/or any other specific agreement for JLK Hosting services is between JLK Hosting and its customers only and will not confer any rights in any third party except as otherwise expressly provided by JLK Hosting.

Payment

All the services are to be paid in advance of the provision of services. The payment must be made in the same currency that is indicated on the invoice. The customer has five business days to pay for the services he uses, after the invoice has been sent. All invoices will be sent electronically to the email address JLK Hosting has on file for a customer account. If the complete amount of the invoice has not been received in given period of time, the account will be immediately suspended. If an invoice has not been paid for more than fifteen days, the account will be closed and all the data of the customer will be deleted. JLK Hosting cannot be held responsible for any damage caused to the customer by the suspension or the deletion of his account.

Third Party Providers

You agree that certain services may be provided by third party providers of JLK Hosting and that your use of such services may be subject to further agreements, policies, terms, and conditions in addition to those contained or referenced in this Agreement.

False Registrations

JLK Hosting will refuse all orders where the address given during registration does not match the IP address of origin of said registration. Use of a proxy service during the registration and order process shall be grounds for immediate termination of your account.

This means that if you cancel your service within 30 days and request a refund you will receive a refund in full via the same means as which you paid. If your hosting package included a "free" domain name registration and you cancel your hosting package, the cost of that domain registration will be deducted from your refund. For instance, if your hosting package cost $23.88 and you received a domain name worth $9.95, and you cancel within 30 days, you will receive a refund of $23.88 less $9.95 or $13.93.
